1. ABOUT THIS POLICY
This policy explains the payment, booking, cancellation, rescheduling and refund arrangements for services supplied by Elevate Aviation.
Elevate Aviation Australia is operated by Daniel John Kirkpatrick, a sole trader trading as Elevate Aviation Australia (ABN 28 826 796 705).
In this policy, “Elevate Aviation”, “we”, “us” and “our” refer to Daniel John Kirkpatrick trading as Elevate Aviation Australia.
By paying for, confirming or commencing a service, you agree to this policy and any additional terms provided for that service.
Nothing in this policy excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
2. SERVICES COVERED
This policy applies to services supplied by Elevate Aviation, including:
• Flight tests
• Proficiency checks
• Flight reviews
• Foreign licence conversion assessments
• CASA IPC Overseas services
• AROC courses and assessments
• Aviation English Language Proficiency assessments
• Flight activity endorsement training
• Other aviation training, assessment and administrative services
Aircraft hire, simulator hire, instructor services, flight training, travel and other services supplied by third parties may be subject to separate terms established by those providers.
3. PRICES, PAYMENT AND BOOKING CONFIRMATION
All prices are displayed or quoted in Australian dollars.
If a price states that GST is not applicable, no GST is included in that price.
Unless otherwise agreed in writing, payment is required in full before a booking, enrolment or assessment is confirmed.
Once payment has been received, the booking is confirmed and Elevate Aviation may begin administrative preparation and make commitments to examiners, simulator centres, airlines, accommodation providers and other suppliers.
Submitting an enquiry or requesting a preferred date does not confirm a booking.
Payments may be processed through PayPal or another payment provider. The payment provider’s separate terms and processing times may also apply.
You are responsible for checking that the booking confirmation details are correct and notifying us promptly if anything needs to be changed.
4. STANDARD BOOKINGS
This section applies to bookings that do not involve an AROC course, an Aviation English Language Proficiency assessment, interstate or international travel, a foreign ATPL conversion requiring travel or simulator arrangements, or a simulator-based test or check.
If you need to cancel or reschedule a standard booking, please notify Elevate Aviation as soon as possible.
MORE THAN 48 HOURS’ NOTICE
If you cancel more than 48 hours before the scheduled commencement time, no Elevate Aviation cancellation fee will normally apply.
You will receive a refund of amounts paid for services not yet provided, less any disclosed, actual and non-recoverable third-party costs already incurred specifically for your booking.
BETWEEN 24 AND 48 HOURS’ NOTICE
If you cancel between 24 and 48 hours before the scheduled commencement time, Elevate Aviation may retain or charge an amount reflecting the reasonable administrative costs and loss caused by the cancellation.
This amount will not normally exceed 25 per cent of the Elevate Aviation service fee, together with any disclosed, actual and non-recoverable third-party costs.
LESS THAN 24 HOURS’ NOTICE OR NON-ATTENDANCE
If you cancel less than 24 hours before the scheduled commencement time or do not attend, Elevate Aviation may retain or charge an amount reflecting the actual and reasonable costs and loss resulting from the cancellation.
Where the reserved time cannot reasonably be filled by another customer, this amount may be up to the full Elevate Aviation service fee, together with any disclosed and non-recoverable third-party costs.
Cancellation charges are not intended to operate as a penalty. They will be reduced where Elevate Aviation is able to avoid or recover the relevant loss, including by filling the booking with another customer.
5. AROC COURSE PURCHASES
An AROC course enrolment is confirmed once payment has been received.
AROC course fees are not refundable where a customer:
• Changes their mind
• Decides not to commence or complete the course
• No longer requires the qualification
• Fails to complete the course or assessment within 42 days
• Does not achieve the required assessment standard
• Allows their course access to expire, where an access period has been specified, if not the standard duration is 42 days
• Provides incorrect information when enrolling
Course access and materials are supplied only to the person named in the enrolment and must not be shared with another person.
Payment is for access to the course, course materials, administration and the included services described at the time of purchase. It does not guarantee successful completion or the issue of a certificate.
This section does not exclude any right or remedy available under the Australian Consumer Law if the course or digital service is faulty, materially different from its description or cannot be supplied as agreed.
6. AVIATION ENGLISH LANGUAGE PROFICIENCY ASSESSMENTS
An Aviation English Language Proficiency assessment booking is confirmed once payment has been received. All assessments must be conducted in Perth, WA at the located selected by us unless agreed to otherwise.
AELP assessment fees are not refundable where a candidate:
• Changes their mind
• Cancels the assessment
• Does not attend
• Arrives too late for the assessment to be completed
• Does not provide the required identification or documentation
• No longer requires the assessment
• Does not achieve the desired assessment result
A request to change the assessment date may be accepted at the discretion of Elevate Aviation, subject to availability and any reasonable rescheduling costs.
Payment is for the professional delivery and administration of the assessment and does not guarantee a particular assessment result.
This section does not exclude any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
7. INTERSTATE, FOREIGN ATPL CONVERSIONS AND SIMULATOR BOOKINGS
This section applies to:
• Services requiring interstate, regional or international travel
• Foreign ATPL conversion assessments involving travel or simulator arrangements
• Flight tests, proficiency checks and other assessments conducted in simulators within Australia
• Flight tests, proficiency checks and other assessments conducted in aircraft within Australia
• Flight tests, proficiency checks and other assessments conducted in simulators overseas
• Services requiring pre-booked flights, accommodation, ground transport or simulator access
Once payment has been received, the booking is confirmed and Elevate Aviation may make non-recoverable travel, accommodation, simulator and administrative commitments.
If the customer cancels the booking or requests a change to the confirmed booking date after payment has been received, a cancellation or rebooking charge of 70 per cent of the total invoice amount will apply.
This charge reflects the actual and reasonable costs and losses associated with the booking, which may include:
• Simulator hire and reservation charges
• Airfares
• Accommodation
• Pre-arranged ground transport
• Examiner time reserved for the booking
• Administrative and assessment preparation already completed
• Currency-conversion or international transaction costs
• Other non-recoverable third-party charge
Where possible, Elevate Aviation will attempt to transfer travel, accommodation or simulator arrangements to a new date. Any recovered or avoided amount will be taken into account when determining the final charge.
The refundable amount of 30 per cent of the total invoice amount will be returned using the original payment method.
This section takes priority over the standard cancellation arrangements in section 4 for services to which this section applies.
Nothing in this section excludes any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
8. ELIGIBILITY AND REQUIRED DOCUMENTATION
You are responsible for ensuring that you meet the applicable eligibility, training, recommendation, recency, documentation and identity requirements for your service.
Elevate Aviation will provide reasonable guidance about known requirements but cannot guarantee eligibility until the relevant documents and circumstances have been reviewed.
If a service cannot proceed because you:
• Have not completed the required training
• Do not hold the required recommendation
• Cannot provide required identification or aviation documents
• Do not meet applicable eligibility or recency requirements
• Arrange an unsuitable aircraft or simulator
• Do not obtain a required approval
• Arrive too late for the service to be completed safely or lawfully
the applicable cancellation provisions in this policy will apply.
9. WEATHER, AIRCRAFT AND OPERATIONAL DISRUPTIONS
Aviation services may be affected by weather, aircraft serviceability, simulator availability, airspace restrictions, operational requirements, illness, safety considerations or other circumstances outside the reasonable control of either party.
Safety and regulatory compliance will always take priority over completing a service on the originally scheduled date.
Where a service cannot safely or lawfully proceed for one of these reasons, Elevate Aviation will work with you to arrange another suitable date.
Elevate Aviation will not normally charge an additional rescheduling fee for the first weather, aircraft-serviceability or operational reschedule.
Actual and non-recoverable travel, accommodation, aircraft, simulator, transport or other third-party costs may remain payable.
Where arrangements can be transferred, refunded or recovered, the amount recovered will be credited or refunded to the customer.
10. CANCELLATION OR RESCHEDULING BY ELEVATE AVIATION
Elevate Aviation may cancel or reschedule a service because of:
• Illness or incapacity
• Safety concerns
• Weather conditions
• Aircraft or simulator unavailability
• Operational disruption
• Regulatory requirements
• Circumstances outside our reasonable control
If Elevate Aviation cancels a service and cannot provide a suitable alternative within a reasonable period, you may choose to receive:
• A refund of the Elevate Aviation fee paid for the service not provided; or
• A credit towards another agreed date or service
You will not be required to accept a credit instead of a refund where you are legally entitled to a refund.
Where a cancellation is caused by Elevate Aviation, we will also discuss the reasonable treatment of directly affected costs.
Your rights under the Australian Consumer Law remain unaffected.
11. THIRD-PARTY COSTS
Your service may require arrangements with third parties, including:
• Aircraft operators
• Flight training organisations
• Simulator centres
• Instructors or other examiners
• Airlines and accommodation providers
• Ground-transport providers
• Document-certification or administrative providers
These providers may impose their own payment, cancellation and refund terms.
Where Elevate Aviation incurs a third-party cost specifically for your booking, that cost will be disclosed where reasonably practicable.
A refund may be reduced by an actual, reasonable and non-recoverable third-party cost where permitted by law.
Elevate Aviation will take reasonable steps to recover refundable amounts from the relevant provider.
12. PERSONALISED AND ADMINISTRATIVE SERVICES
Some services involve substantial preparation or administration before the scheduled assessment, including:
• Foreign ATPL conversion assessments
• CASA IPC Overseas coordination
• CASA approval requests
• Document reviews
• Preparation of forms and assessment material
• Liaison with overseas examiners or simulator centres
If you cancel after this work has commenced, any refund will be calculated by deducting:
• The reasonable value of work already completed
• Actual and non-recoverable third-party costs
• Any other reasonable loss resulting from the cancellation
You may request an explanation of the amount retained.
Where section 7 applies to the booking, its maximum cancellation or rebooking charge will also apply.
13. ASSESSMENT RESULTS AND REASSESSMENT
Payment is for the professional delivery and administration of the relevant training, test, check, review or assessment. It does not guarantee a successful result.
A candidate is not entitled to a refund solely because they:
• Do not achieve the required standard
• Are found not yet competent
• Do not obtain the desired licence, rating, endorsement or assessment outcome
• Disagree with a properly conducted assessment result
Any subsequent training, reassessment, resit or additional administration may attract a separate fee.
This section does not limit your rights if the service itself was not provided with appropriate care and skill or otherwise failed to comply with an applicable consumer guarantee.
14. EXCEPTIONAL CIRCUMSTANCES
We understand that illness, family emergencies and other unexpected circumstances can occur.
Please contact us as soon as possible if exceptional circumstances affect your booking.
Elevate Aviation may waive or reduce a cancellation or rescheduling charge where it is reasonable and fair to do so.
We may request reasonable supporting information before approving an exception.
15. REFUNDS
Approved refunds will normally be returned using the original payment method.
We will process an approved refund within a reasonable period. Your bank or payment provider may require additional time before the funds appear in your account.
Unless required by law, a refund will not include costs that:
• Were paid directly to another provider
• Have already been supplied or used
• Are actual, reasonable and non-recoverable
• Relate to work already completed at your request
16. AUSTRALIAN CONSUMER LAW
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Depending on the circumstances, you may be entitled to have a problem corrected, cancel a service, obtain a refund for an unused portion of a service or receive compensation for reasonably foreseeable loss or damage.
17. REQUESTING A CANCELLATION, CHANGE OR REFUND
To cancel or reschedule a booking or request a refund, contact Elevate Aviation using the details below.
Please include:
• Your full name
• The service booked or purchased
• The scheduled date, if applicable
• Your invoice or transaction details
• The reason for your request
• Your preferred outcome
We will review your request and respond within a reasonable period.
18. CHANGES TO THIS POLICY
Elevate Aviation may update this policy when our services, operating arrangements or legal obligations change.
The version that applies to a confirmed booking will generally be the version provided or published when the booking was made, unless a change is required by law or agreed with you.
